By choosing to participate in any travel experience organized by Off The Radar, whether it is a group tour, solo travel plan, special-interest itinerary, or custom package, you acknowledge and accept the terms outlined herein.
As a participant, you understand that you may be required to review and sign a Release of Liability, Indemnification, and Assumption of Risk Agreement (“Release”) before your booking is confirmed and your reservation is secured. This document is designed to ensure that you are aware of, and voluntarily accept, any potential risks associated with travel—particularly in remote, natural, or culturally sensitive environments.
While Off The Radar endeavors to support you with general travel guidance—including information on visa requirements, passport validity, local customs, currency exchange, health precautions, vaccination recommendations, and travel advisories—it remains solely your responsibility to ensure that all required documents and authorizations (including valid passports, visas, permits, health certificates, insurance policies, etc.) are obtained and kept up to date.
We strongly advise all travelers to obtain appropriate travel insurance at their own expense. This may include, but is not limited to, coverage for medical emergencies, trip cancellations, lost baggage, theft, or personal liability. Off The Radar will not be liable for any loss or expense incurred due to your failure to secure appropriate coverage or fulfill documentation requirements.
Additionally, all itineraries and service descriptions provided by Off The Radar are subject to change due to operational requirements, external factors, or unforeseen events. These may include alterations in accommodations, changes in transportation providers, shifts in weather conditions, or adjustments in local regulations. Every effort will be made to maintain the integrity of the travel experience, and any changes will be communicated to the client as early as possible.
Our services also extend to managing on-ground logistics, coordinating with third-party vendors (hotels, transport agencies, activity providers, guides, government organisations etc.), and offering personalized recommendations for restaurants, attractions, and excursions. However, since many of these services are performed by independent contractors, Off The Radar does not assume responsibility for the acts, omissions, or service quality of these third parties.
By availing yourself of Off The Radar’s services, you agree to adhere to all instructions, terms, and guidelines provided before and during your travel. You also acknowledge that Off The Radar retains the right to deny, cancel, or discontinue participation in any tour or activity if a traveler’s behavior is deemed unsafe, unlawful, or disruptive to the group.
By registering for or participating in any tour, activity, or travel service organized by Off The Radar, you acknowledge and fully understand that such experiences inherently involve risks—both known and unforeseen. These risks may arise during travel in both urban settings and remote destinations, and they may occur anytime and through various modes of transport including air, rail, road, watercraft, or on foot.
You understand and accept that participation in tours, excursions, or custom travel packages—particularly those that include wildlife exploration, nature trails, adventure activities, or photography outings—may expose you to hazards that could result in physical or psychological injury, property loss or damage, illness, or, in rare cases, fatality. These risks may stem from environmental conditions, natural disasters, wildlife encounters, weather changes, political unrest, terrorism, or the failure of safety protocols beyond the control of Off The Radar.
You further recognize that some destinations may have limited access to timely medical assistance, and that emergency evacuation may be delayed or unavailable due to geographic, infrastructural, or logistical constraints.
You are also aware that Off The Radar relies on a network of independent third-party service providers—including but not limited to local transport companies, hotels, resorts, lodges, guides, restaurants, activity operators and government organisations—to deliver components of your travel experience. While we make every effort to vet our partners for quality and safety, we cannot assume liability for any act, error, omission, negligence, or misconduct on their part, nor for any resulting injury, inconvenience, or loss.
By choosing to travel with Off The Radar, and to the fullest extent permitted by applicable law, you voluntarily accept all associated risks and agree to participate at your own discretion and responsibility. You expressly waive any right to bring legal action against Off The Radar, its directors, employees, agents, affiliates, or partners in connection with any injury, damage, delay, disruption, or loss sustained during or resulting from your participation.
This agreement extends to and is binding upon not only yourself but also your heirs, legal representatives, successors, and any minors or dependents traveling under your care. You affirm that you are solely responsible for determining whether you are physically and mentally fit to participate in such activities and that you will seek medical advice in advance if unsure.
By continuing with your booking and participation, you confirm that you have read, understood, and freely accepted these conditions, and that you assume all risks involved.
Participation in safari and wildlife tours is subject to availability and governed by applicable local and national regulations. Guests must provide valid identity proof before entering any wildlife reserve, as mandated by park authorities. All safari bookings must be made with 100% advance payment, and these bookings are strictly non-refundable under any circumstances. It is important to note that park authorities reserve the right to cancel or refuse permits without prior notice, and such decisions are beyond the control of Off The Radar.
Costs associated with permits, vehicles, guides, and entry fees are subject to change, and any differences arising at the time of entry must be borne by the guest. Safari routes and timings are determined solely by the park administration and may be altered without prior intimation for safety or logistical reasons. Participants are required to arrive at the designated safari boarding point at least 15 minutes before the scheduled departure; late arrivals may forfeit their opportunity without refund.
Strict adherence to park rules is mandatory, including prohibitions on feeding, touching, teasing, or otherwise disturbing wildlife. Violations of these rules may result in fines, penalties, or expulsion from the park. In such cases, guests shall be solely responsible for any legal consequences, including payment of fines directly to the concerned authorities. Off The Radar shall not be held liable for any action taken by park or government officials, including detainment, arrest, or imprisonment of the violator. Each wildlife park may have its own specific set of regulations, and it is the guest’s responsibility to familiarize themselves with and comply with all applicable rules. Furthermore, no refunds will be issued for safaris that are canceled or interrupted due to weather disruptions, administrative directives, or government-imposed restrictions.
By participating in any Off The Radar tour or trip, you confirm that you are in good physical and mental health. It is your responsibility to disclose any medical conditions, dietary restrictions, or special needs in advance.
Some trips may involve physical activity, exposure to natural elements, or visits to remote areas. Off The Radar is not responsible for any health complications that may arise during the trip. Travel insurance with medical coverage is strongly recommended.
Off The Radar acts as an intermediary for services provided by independent contractors. We do not accept liability for any act, error, omission, injury, loss, accident, or delay caused by third-party vendors, including but not limited to hotels, airlines, transportation services, or guides.
By registering for or participating in any travel program offered by Off The Radar, you confirm that you have read, comprehended, and accepted the terms outlined herein, including the inherent risks associated with adventure and experiential travel.
As a condition of your participation, you agree—on behalf of yourself and any accompanying minors—for whom you are responsible—to indemnify, defend, and hold harmless Off The Radar, along with its directors, employees, agents, contractors, representatives, partners, affiliates, and third-party service providers (collectively referred to as “Indemnitees”), from and against any and all claims, actions, losses, damages, liabilities, and expenses. This includes but is not limited to physical injury, illness, death, loss of property, legal costs, or any other damage that may occur before, during, or after your trip.
This indemnification applies regardless of whether such events arise from active or passive negligence, misconduct, errors, or omissions on the part of the Indemnitees, and includes all losses that may result from actions of third-party vendors, wildlife interactions, transportation mishaps, or unforeseen circumstances.
You further acknowledge that you are responsible for any conduct or negligence on your part that causes harm to the group, the environment, or others during the course of the trip. This agreement extends to legal costs incurred by Off The Radar or its representatives in defending any such claims. This indemnity remains binding upon your heirs, legal representatives, successors, and assigns.
In further acknowledgment of the services being rendered by Off The Radar, and as part of the agreement allowing your participation in any trip, tour, or custom itinerary, you voluntarily and knowingly agree to release and discharge Off The Radar and all affiliated parties—its officers, employees, subcontractors, guides, agents, suppliers, and associated vendors (collectively, “Releasees”)—from any and all liability, whether arising from negligence or otherwise.
This release includes any claims for injuries, accidents, illness, death, delays, damage to personal belongings, or financial loss that may occur in connection with transportation, accommodations, meals, guided activities, or interactions with natural elements, animals, or third-party service providers. It is understood that even when all precautions are taken, there remains a possibility of unexpected situations or outcomes beyond the reasonable control of the Releasees.
By accepting these terms, you waive your right to pursue legal action or seek compensation from Off The Radar or its affiliates for any direct or indirect harm suffered during the travel experience. This release of liability applies to all phases of your trip—including pre-departure, transit, participation, and post-trip periods—and covers both civil and criminal claims.
This agreement shall be effective and enforceable to the maximum extent permitted by applicable law and remains binding on your estate, heirs, family members, and any minor children under your care who participate in the travel program.
All prices are quoted in Indian Rupees (INR), unless stated otherwise. Prices are current at the time of publication and are subject to change without prior notice due to changes in supplier rates, taxes, currency fluctuations, or fuel surcharges.
Some prices may be listed in foreign currencies for convenience. In such cases, currency conversion fees may apply depending on your payment method and provider. You are responsible for any additional costs incurred due to such conversions.
To secure your participation in any tour, event, or custom travel service offered by Off The Radar, all bookings must be made in accordance with the terms outlined below.
A deposit, as specified at the time of booking, is mandatory to initiate your reservation. The booking will be considered tentative until the deposit is received and acknowledged by Off The Radar. Full payment must be completed prior to the departure date, as per the payment schedule communicated to you. Failure to meet the payment deadlines may result in automatic cancellation of your booking without any obligation of refund from our side.
All bookings are subject to availability at the time of confirmation. Prices are based on prevailing rates at the time of publication but may change due to fluctuations in exchange rates, fuel surcharges, taxation changes, or government-imposed levies. In the rare event of a pricing discrepancy due to technical errors or system malfunctions, Off The Radar reserves the right to correct the pricing and notify you of any necessary adjustments.
Special requests, such as dietary preferences, room configurations, or accessibility requirements, must be communicated in writing well in advance. While we strive to accommodate such requests, they are not guaranteed unless explicitly confirmed in writing.
Any discounts, promotional offers, or package deals offered by Off The Radar are subject to specific terms and cannot be combined with other offers or adjusted retrospectively, unless explicitly stated in the promotion.
Late bookings or last-minute modifications to existing itineraries may incur additional charges, which will be communicated at the time of request.
By confirming a booking with Off The Radar, you acknowledge and agree to abide by the booking terms, payment conditions, and related policies as outlined in this section and the broader terms and conditions.
We understand that plans may change, and we strive to offer fair and transparent policies for cancellations and modifications. If you wish to cancel or make changes to your confirmed booking, you must notify us in writing at the earliest possible time. The applicable cancellation charges will depend on the nature of the service, the time of cancellation relative to the departure date, and any non-refundable costs already incurred.
All cancellations and modifications are subject to Off The Radar’s official Cancellation and Refund Policy, and by proceeding with any booking, you expressly agree to be bound by these terms.
In the event of an eligible refund, the amount will be processed within 15 to 30 working days from the date we send you a written cancellation confirmation. Refunds will be issued via the same payment method originally used during the transaction.
Please note: In some cases, refunds may be delayed beyond the stated time frame due to processing timelines or policies of third-party service providers, including but not limited to hotels, airlines, transportation agencies, or financial institutions. Off The Radar shall not be held liable for any such delays resulting from circumstances beyond our control.
Additionally, certain services or custom components may carry non-refundable deposits or strict cancellation terms imposed by third-party suppliers. These conditions will be communicated to you at the time of booking, and any deductions or non-refundable charges will be clearly reflected in your final refund amount, if applicable.
We recommend reviewing all booking details thoroughly and considering travel insurance to protect against unforeseen cancellations or interruptions.
For tailor-made travel services, Off The Radar will create a personalized itinerary based on your requirements. This process may involve a planning fee, particularly for complex itineraries. Once finalized and accepted, the itinerary becomes binding and any requested changes may incur additional costs.
We encourage resolving disagreements amicably. However, if necessary, disputes shall be settled through arbitration in accordance with Indian Arbitration laws.
Any controversy, dispute, or claim arising out of or in connection with the services provided by Off The Radar, including but not limited to claims related to illness, personal injury, death, property damage, delays, service modifications, accommodation changes, or any additional costs or inconveniences caused by unforeseen events, shall be resolved exclusively through binding arbitration.
This includes disputes arising directly or indirectly from, but not limited to, the failure of equipment or transportation, acts of nature (including natural disasters), war, civil unrest, terrorism, government actions, military conflicts, quarantines, strikes, weather-related disruptions, theft, detainment, or any force majeure events beyond the control of Off The Radar or its partners.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mysore, Karnataka, India, which shall be the venue for arbitration. The language of arbitration will be English.
Guests explicitly acknowledge and agree to waive their right to pursue legal action in court, and accept arbitration as the sole and exclusive means of dispute resolution. This clause is binding and extends to any minors or dependents accompanying the guest.
All claims or disputes must be submitted in writing within thirty (30) days from the completion of the tour or service. Any claim not made within this timeframe shall be deemed waived. Off The Radar is not responsible for any legal expenses incurred by the guest, regardless of the arbitration outcome.
This arbitration provision in no way alters, reduces, or waives any of the other terms outlined in the sections titled Release of Liability, Indemnity, or Awareness and Assumption of Risk. These provisions remain valid and enforceable under all circumstances.
By participating in any tour, expedition, or event organized by Off The Radar, you acknowledge and agree to the following conditions regarding the use of photographs, videos, and other media captured during the course of your experience:
Off The Radar reserves the right to photograph, film, or record guests during tours and related activities for documentation and promotional use. This includes both still images and video recordings.
By registering to or availing any services, you grant Off The Radar permission to use, reproduce, and distribute any photographs or recordings that may include your likeness, voice, or image, in any format, for promotional, marketing, advertising, and educational purposes. This may include publication on our website, social media platforms, printed materials, brochures, and third-party advertising platforms.
All digital media captured by Off The Radar or its authorized representatives becomes the intellectual property of Off The Radar, which retains full rights to store, archive, edit, and reuse such content in future marketing campaigns or other promotional contexts without additional notification or consent.
If you do not wish to appear in any media, it is your responsibility to inform Off The Radar in writing prior to the start of the tour. Reasonable efforts will be made to honor your request; however, complete exclusion from group photographs or public spaces cannot be guaranteed.
Off The Radar will not compensate participants for the use of images or recordings taken during the tour, nor will it be liable for unauthorized third-party use once such content is published in the public domain.
Off The Radar provides curated tours, custom travel experiences, and expeditions, and these services are considered delivered once the registered participant completes the scheduled duration of the tour in accordance with the itinerary confirmed at the time of booking. The fulfillment of our services is based on the execution of the planned activities as agreed upon, and we consider the service fully rendered once the participant has engaged in the tour or travel experience, regardless of whether every element of the itinerary is personally utilized.
Participants acknowledge that no requests for itinerary extensions, rescheduling, or substitutions will be entertained in cases where the individual, whether due to voluntary choices or involuntary circumstances such as flight delays, natural events, medical emergencies, civil unrest, or other unforeseen disruptions, is unable to participate in part or whole of the trip after registration. Such absences will not be regarded as service deficiencies or failures on the part of Off The Radar. Similarly, if a participant fails to adhere to scheduled timelines, arrives late for departures, or withdraws due to personal circumstances, Off The Radar will not be held responsible for any resulting impact on their experience.
In the case of custom travel arrangements, service delivery is deemed complete upon the successful provision of the itinerary as originally approved, regardless of whether the participant chooses to engage with each activity. Any add-ons, deviations, or spontaneous requests made during the trip are subject to availability and may incur additional charges. Off The Radar is under no obligation to honor such requests unless formally agreed to in writing.
In the event of disruptions caused by force majeure, government regulations, natural disasters, pandemics, or other unforeseen circumstances beyond our control, Off The Radar will strive to offer, but can not guarantee reasonable alternatives where feasible. However, once the tour has commenced, no refunds or compensation shall be offered for changes or interruptions resulting from such events, and the services provided up to that point will be considered valid and complete.
